Understanding child support and where you fit in

When you go through a divorce, many financial questions will come to light. This is even more so the case if you have one or more child with your former partner.

In the case of child support, there are two sides:

— One partner receives child support to care for the child or children.

— The other partner is required by the law to pay child support.

There are times when both parents agree on custody and child support, making the process much easier. Conversely, there are times when the couple is not getting along and is not willing to compromise. When this happens, it can be difficult to finalize an amount and move on. However, it is the court, not the parents, who make decisions regarding child support.

In the state of California, for example, there is a formula for calculating child support. Even so, there are factors that determine how much will be paid each month, such as the percentage of custody, the income of both parents and the family lifestyle.

If you are going through divorce, there is a chance you will either receive child support or owe this obligation on a monthly basis.

It is good to learn as much as you can early in the process, as this will help you along the way. As frustrating as it may be, all you can do is provide the court with the appropriate information and then let the legal system decide what happens next.
